1. Acceptance of Terms

By accessing or using Fately ("Service," "we," "our," or "us") at myfately.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. We reserve the right to modify these Terms at any time, and your continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

Fately provides AI-generated self-discovery reports based on Ancient Chinese Five Elements philosophy (Wu Xing), calculated from a user's date, time, and place of birth. Our offerings include:

• A free introductory reading
• A Full Birth Map Reading (paid)
• A Bundle (Full Birth Map Reading plus a Compatibility Reading)
• A Compatibility Reading add-on, comparing the birth energies of two people. Any relationship type is welcome, not limited to romantic partners.

3. No Account Required

Fately does not require you to create an account, register, or provide a password to use the Service. You provide your birth details for the purpose of generating your reading, and, if you choose, an email address to receive a copy of your reading. We do not store login credentials because none are created.

4. Payments and Refunds

4.1 Pricing. All prices are displayed in USD. Prices are subject to change at our discretion; changes will not affect purchases already completed.

4.2 Payment Processing. Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service. Fately does not receive or store your full card details.

4.3 Refund Policy. Because each reading is generated instantly and personalised to the birth details you provide, we are generally unable to offer refunds once your report has been delivered. If something goes wrong on our end, for example you were charged but never received your reading, or you were charged twice by mistake, contact us at myfately@gmail.com and we will resolve it. Nothing in this policy limits your rights under the Australian Consumer Law.

5. Intellectual Property

All content on Fately, including but not limited to text, graphics, logos, page design, and AI-generated report content, is the property of Fately and protected by copyright law. You may not reproduce, distribute, or create derivative works from this content without our express written permission. The reading generated for your personal use is yours to keep and share for personal, non-commercial purposes.

6. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to our systems or data belonging to other users
• Interfere with or disrupt the Service
• Use automated tools (bots, scrapers) to access the Service without our permission
• Reverse-engineer, copy, or attempt to extract our underlying prompts, calculations, or proprietary methods
• Misrepresent your identity or provide false birth information with intent to defraud
• Use your report, or any content from it, to mislead others, misrepresent it as professional advice, or in false advertising

7. Disclaimer of Warranties

Please read this section carefully.

• Fately reports are generated by artificial intelligence and are based on Ancient Chinese metaphysical cosmology (Five Elements / Wu Xing philosophy). They are provided for entertainment, self-reflection, and personal exploration purposes only.
• The Service is provided "as is," without warranties of any kind, express or implied. We do not guarantee the accuracy, completeness, or suitability of any reading for any individual.
• Reports do not constitute, and should not be relied upon as, medical, psychological, psychiatric, legal, financial, or any other form of professional advice.
• No prediction of specific future events is intended or implied.
• Your report should not be used as the basis for any decision regarding: medical, mental health, or psychiatric treatment; investment, financial planning, or major purchases; marriage, divorce, or other significant relationship decisions; career changes, resignations, or business decisions; or legal matters or disputes.
• By using the Service, you confirm you are 18 years of age or older.
• If you are facing a serious personal, medical, legal, or financial decision, please consult a qualified professional. You are fully responsible for your own decisions and actions.

8. Limitation of Liability

To the maximum extent permitted by law, Fately shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, arising from your use of, or inability to use, the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the relevant report.

Nothing in these Terms excludes or limits any guarantee, right, or remedy you have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.

9. Indemnification

You agree to indemnify and hold Fately harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or your violation of these Terms.

10. Third-Party Services

The Service relies on the following third-party providers to operate:

• Stripe, for payment processing
• Anthropic (Claude), for AI-generated report interpretation
• Make.com, for workflow automation and data handling between the above services
• Resend, for transactional email delivery (sending your reading to your inbox)

We are not responsible for the practices, availability, or content of these third-party services. Your use of the Service is also subject to the relevant terms of these providers where applicable.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the Service will be resolved in the courts of Victoria, Australia.

12. Changes to Terms

We may update these Terms from time to time. We will note significant changes with an updated "Last Updated" date at the top of this page. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
