Welcome to Fately. These Terms of Service ("Terms") govern your use of myfately.com (the "Site") and any reports, content, or services we provide (together, the "Service"). By using the Site, you agree to these Terms.
1. Who Can Use Fately
You must be at least 18 years old to use this Service. By using the Site, you confirm that you are 18 or older.
2. Nature of Our Service
Fately generates personalised reports based on Ancient Chinese metaphysical cosmology, including traditional Five Elements (Wu Xing) philosophy. Reports are generated using artificial intelligence based on the birth information you provide.
Our reports are provided for entertainment, self-reflection, and personal exploration purposes only. They have no scientific basis and do not constitute — and should not be relied upon as — medical, psychological, psychiatric, legal, financial, or any other form of professional advice. We do not provide prediction, prophecy, or guaranteed guidance about your future.
Specifically, your report should not be used as the basis for any decision regarding:
Medical, mental health, or psychiatric treatment
Investment, financial planning, or major purchases
Marriage, divorce, or other significant relationship decisions
Career changes, resignations, or business decisions
Legal matters or disputes
If you are facing any of the above, please consult a qualified professional. You are fully responsible for your own decisions and actions — Fately is not responsible for any outcome resulting from your use of, or reliance on, our reports.
3. Accounts and Information You Provide
To generate your report, you provide us with your date of birth, time of birth, place of birth, and gender. You are responsible for ensuring this information is accurate — the accuracy of your report depends on it.
4. Purchases and Payment
Some reports and features are offered for a one-time fee, shown in USD at checkout. Payments are processed securely through Stripe. By purchasing a report, you authorise us to charge the payment method you provide for the listed amount.
5. Refunds
Because our reports are digital content generated and delivered immediately upon purchase, refunds are not automatic. However, if you're unsatisfied with your report or believe there has been an error, you may submit a refund request within 7 days of purchase to myfately@gmail.com. Each request is reviewed individually — we're reasonable people and will look at the specifics of your situation.
This is in addition to, and does not limit, any guarantee, right, or remedy you have under applicable consumer law in your jurisdiction (for example, the Australian Consumer Law, which provides guarantees that cannot be excluded).
6. Intellectual Property
All content on the Site — including text, design, graphics, the Fately name and brand, and your generated report — is owned by or licensed to Fately. Your purchased report is for your personal, non-commercial use. You may not resell, redistribute, or publicly republish reports without our permission.
7. Acceptable Use
You agree not to:
Use the Site for any unlawful purpose
Attempt to interfere with or disrupt the Site or its underlying systems
Misrepresent your identity or provide false birth information with intent to defraud
Copy, scrape, or reproduce the Site's content or underlying report logic
Use your report, or any content from it, to mislead others, misrepresent it as professional advice, or in false advertising
8. No Professional Advice / No Guarantee of Outcomes
Fately makes no representations or warranties regarding the accuracy, completeness, or suitability of any report for your individual circumstances. Individual results and interpretations will vary. Reading your report and acting on it is entirely your choice and responsibility.
9. Limitation of Liability
To the maximum extent permitted by law, Fately and its owner are not liable for any indirect, incidental, or consequential damages arising from your use of the Site or reliance on any report. Our total liability for any claim related to the Service is limited to the amount you paid us for the relevant report.
Nothing in these Terms excludes or limits any guarantee, right, or remedy you have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.
10. Changes to the Service or Terms
We may update these Terms, the Site, or our reports at any time. Continued use of the Site after changes means you accept the updated Terms.

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles.
